Terms of Service for Orchestrel Play
Last updated: October 2026
These Terms apply to Orchestrel Play. The Terms of Service for Maestro is a separate document governing a different product.
1. Service Description
These Terms of Service ("Terms") govern your access to and use of Orchestrel Play ("Play" or the "Service"), a subscription service operated by Orchestrel AI SARL, a Luxembourg private limited liability company located at 29 rue d'Esch, L-3920 Mondercange, Luxembourg ("Company", "we", "us", or "our").
Play provides hosted agent sessions, each called a lane. A lane is one parallel session of a given lane type. We currently offer two lane types: Craft, for dexterous, multi-step work (builds, refactors, careful long-horizon work), and Scout, for fast, light work (lookups, search, triage). Lanes run the agents you point them at: OpenCode, OpenClaw, and other supported agents.
Each lane has its own fixed monthly price and includes unlimited tokens per session: sessions are not metered by token count and are not cut off for running out of tokens. The model is part of the lane: each lane type ships with its own model tier, which we tune and upgrade; you do not select or configure the model.
2. Accounts and Workspaces
- Eligibility. You must be at least 18 years old and authorized to enter into a binding agreement to use the Service.
- Workspace. A Play subscription is organized as a workspace associated with a work email address. The workspace holds your lanes. You are responsible for all activity under your workspace, including credentials or tokens used to connect your agents to Play lanes.
- Lane mix. You may add, remove, or change the type of lanes at any time. Pricing follows the resulting mix, applied from the next billing.
3. Pricing and Payment
- Lane pricing. Lanes are billed per lane, per month, at a fixed price: Craft at 19.99 EUR per lane per month, Scout at 9.49 EUR per lane per month, plus applicable taxes. Prices are exclusive of applicable taxes (HT); VAT or equivalent is included where applicable, and taxes are calculated at checkout.
- Dev bundle. A workspace running exactly 1 Craft lane and 2 Scout lanes is billed 35.99 EUR per month instead of the per-lane total. The bundle applies and releases automatically as your mix changes.
- Billing cycle. You are billed monthly per lane, starting when your first session runs. We do not charge overage fees of any kind: your bill is exactly the sum of your lanes' monthly prices (or the bundle price).
- Payment method. Payments are processed by our payment provider (Stripe or equivalent). We do not store credit card numbers on our servers.
4. Unlimited Tokens and Fair Use
- No token meter. Lanes are not metered by token count. A session uses as many tokens as the work needs, and nothing counts down while it runs.
- Fair use. If a lane's usage is consistently heavy, we ease back that lane's bandwidth so the platform stays fast for everyone: the session runs a little slower, and it keeps running. We tell you in your dashboard well before you feel it, and we may suggest adding a lane or switching a lane's type.
- No cutoffs, no overage charges. We never cut a session off mid-task and we never auto-charge an overage fee for heavy usage.
5. Acceptable Use
You agree not to use the Service to:
- Engage in any illegal activity, including the development of malware, exploits, or tools designed to compromise other systems.
- Resell or transfer access to the Service to third parties outside your team.
- Reverse-engineer, decompile, or attempt to derive the architecture or source of the Service.
- Conduct automated attacks (DDoS, brute force, scraping at scale) against third-party systems, or abuse the Service to target them.
- Use the Service to generate content that infringes third-party intellectual property rights.
- Circumvent any technical measures intended to limit usage, enforce pricing, or secure the platform, including fair-use mechanisms.
We may suspend or terminate workspaces that violate these Terms, without refund of fees for the month in progress.
6. Intellectual Property
- Your work is yours. You retain full ownership of the work products, artifacts, and content your sessions produce, subject to the licenses of any third-party materials they incorporate.
- Service ownership. Orchestrel AI retains all rights to Play, including its architecture, lane and model-tier management, dashboards, branding, and proprietary systems. You are granted a limited, non-exclusive, non-transferable license to use the Service as provided under these Terms.
- Open-source components. Any open-source software used in the Service remains subject to its original licenses. We do not claim ownership of third-party open-source code.
7. Data and Session Handling
- Sessions run on our infrastructure. To run your work, a session's content (code, prompts, tool outputs, and model responses) is processed on Orchestrel infrastructure and, for inference, transmitted to third-party model providers.
- No training on your data. Session content is never used to train our models or anyone else's models. It is processed to run your work and for nothing else.
- Session storage. We store session data only as needed to run the work and maintain session continuity (resuming a session, preserving its state), per our Privacy Policy.
- As-is. The Service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.
- Your work, your responsibility. Session output is the result of your agents working on your task. We are not liable for bugs, security vulnerabilities, or any other quality issue in work produced by your sessions.
- No consequential damages. In no event shall Orchestrel AI, its founders, employees, or agents be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or business opportunities, arising from use of or inability to use the Service.
- Cap. Our total liability for any claim arising from the Service shall not exceed the total amount paid by you to Orchestrel AI in the 12 months preceding the claim.
- Cancel any time. You may cancel your subscription at any time from your dashboard. Your lanes keep running to the end of the month you have paid for, and you will not be billed again after that.
- No refund for the month in progress. There is no refund for the month you are in when you cancel; you keep access to your lanes until it ends.
- Termination by us. We may terminate your workspace if you materially breach these Terms, with 30 days' written notice (except in cases of illegal activity, which may result in immediate termination without notice).
- Termination by us without cause. If we terminate your workspace without cause, we will refund the unused portion of your current month.
